  • THESE OFFICIAL RULES GOVERN ALL ASPECTS OF PARTICIPATION AND PRIZES AWARDED.
  • All DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

1. Description of Sweepstakes

Welcome to the $100,000 Touchdown Countdown Sweepstakes (the "Sweepstakes"), where participants who sign up for a new Predicts Account (as defined below) and make a deposit of at least Five Dollars ($5), or who submit an eligible alternate entry submission, will receive an Entry (as defined below) into a drawing for a chance to win an opportunity to make a prediction to win a prize of One Hundred Thousand Dollars ($100,000).

The Sweepstakes is sponsored by New Venture II LLC (“BIU”, “FanDuel” or the “Sponsor”), located at 1 Madison Avenue, 23rd Floor, New York, NY 10010.  The terms “you” or “your” mean the person who participates in this Sweepstakes.  Participation in the Sweepstakes is expressly conditioned upon acceptance of and compliance with all of these Sweepstakes “Official Rules”.  Sweepstakes participants may be required to sign paperwork issued by the Sponsor.

2. Sweepstakes Period                                                                                 

The Sweepstakes will begin at 12:00 AM ET on December 22, 2025 and end at 11:59 PM ET on February 05, 2026 (“collectively the Sweepstakes Period”).

3. Eligibility

The Sweepstakes is only open to individuals who are at least 18 years of age and are located in and a resident in South Carolina during the Sweepstakes Period. If your social security number is associated with another FanDuel Account in Sponsor's database, you may only earn one Prize (as defined below) in respect of all such accounts under this Sweepstakes. Employees, officers and directors of the Sponsor, its affiliates, cable/satellite affiliates, advertising and promotion agencies, retailers, distributors (collectively, “Sweepstakes Entities”), and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Sweepstakes or receive a Prize. For purposes of this Sweepstakes, immediate family members are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren and those living in the same household shall mean people who share the same residence at least three (3) months a year, whether legally related or not. A person cannot be an eligible participant or winner if such person is a person: (a) with whom U.S. persons or entities are restricted from doing business under regulations of the Office of Foreign Asset Control (“OFAC”) of the Department of the Treasury (including those named on OFAC’s Specially Designated and Blocked Persons List) or under any statute or executive order; or (b) who is acting, directly or indirectly, for or on behalf of any such person. Void outside of South Carolina and where prohibited by law. Individuals who have entered any self-limited or government agency self-exclusion program or have been otherwise excluded from casinos by a government agency, Sponsor or one of its affiliates or gaming license partners and persons on a Disassociated Patrons, Self-Limit, Involuntary Exclusion, Voluntary Exclusion or Self Exclusion List in jurisdictions which Sponsor or its affiliates or gaming license partners operate are not eligible to participate in the Sweepstakes or receive a Prize (as defined below).

4. Action Required


There are two (2) methods of entry to receive an entry into the Sweepstakes, (each an “Entry”).

Deposit Method: During or prior to the Sweepstakes Period, you must sign up for a new FanDuel Account, make a deposit of at least Five Dollars ($5), you will earn one (1) Entry into the Sweepstakes.

Alternative Method: Alternatively, participants may enter the Sweepstakes by filling out the form at https://forms.gle/Lbb53wo25XvTqmZx5 following all instructions, including submitting your FanDuel Account email address, and clicking the “Submit” button, to receive one (1) Entry. The foregoing method of entry is defined as the “Alternate Method of Entry.” There is no cost to enter into the Sweepstakes via the Alternate Method of Entry.

 

(Collectively, the “Entry Requirements”). There is a limit of One (1) Entry per person regardless of the method used for entry during the Sweepstakes Period. Subsequent attempts made by the same individual to submit multiple Entries by using multiple or false contact information, accounts or otherwise may result in the entrant being disqualified. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes at Sponsor’s sole and absolute discretion. Entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and location) are void. All materials submitted become the physical property of Sponsor and will not be returned. In the event of a dispute over the identity of an online entrant, Entry will be deemed submitted by the registered account holder of the email address associated with the Entry for the domain associated with the submitted address provided that person is eligible. Winners may be required to show proof of being the registered account holder. “Registered account holder” is defined as the person assigned to an email address or username by an internet access provider, online service provider or other organization responsible for assigning email addresses or usernames. In the event a dispute regarding the identity of the individual who actually submitted an Entry cannot be resolved to Sponsor’s satisfaction, the affected Entry will be deemed ineligible. Sponsor’s designated database clock will be the official timekeeper for this Sweepstakes. Those who do not follow all of the instructions, provide the required information in their entry form, or abide by these Official Rules or other instructions of Sponsor may be disqualified. All entrants submitting materials/content as part of the Sweepstakes will be non-exclusively licensing (with the unlimited right to sublicense) to Sweepstakes Entities the right to use such materials, and the images related thereto (including entrant’s name, social media account username and likeness), for any purpose (including any and all commercial purposes) with the right to modify the materials and make derivative works thereof. Entrants represent and warrant that the materials submitted will not infringe or violate any right whatsoever, including, without limitation, any personal rights (e.g., defamation, privacy, false light, moral right, etc.) or any property rights (e.g., copyright, trademark, right to ideas, etc.) of any person or entity and the use thereof will result in no third party liability or obligations. The Sweepstakes Entities may run multiple campaigns, contests, sweepstakes or other promotions simultaneously. Entry into one (1) campaign, contest or sweepstakes does not constitute entry into any other.

5. Claiming Sweepstakes Prize

Upon successfully satisfying the Entry Requirements, as described in Section 4 above, participants will receive one (1) Entry into the random drawing for the Sweepstakes. Within 24 hours of the end of the Sweepstakes Period one (1) “Winner” will be selected by a random drawing from all Entries received during the Sweepstakes Period.  Subject to verification of eligibility and compliance with the terms of these Official Rules, the potential winners will be declared the official “Winners” of the Sweepstakes. Odds of being selected as the Winner depend on the total number of eligible Entries received. The purchase of any goods or services will not increase any participant’s chances of winning.

Such Winner will be contacted by a Sponsor representative notifying they have been selected as the Winner and will receive the opportunity to answer the Sweepstakes question (the “Sweepstakes Pick”). The Winner will submit such Sweepstakes Pick via an online submission form the Sponsor sends directly to such Winner. Winner must communicate acceptance of their selection as the Winner and their Sweepstakes Pick through the online submission form to Sponsor within the time frame specified by Sponsor. Any failure of a Winner to notify and communicate with Sponsor within the timeframes set forth by Sponsor will result in forfeiture of their selection as a Winner. No purchase or deposit is necessary for the Winner to submit the Sweepstakes Pick. For the avoidance of doubt, a Sweepstakes Pick shall not be a futures contract, swap, option or other derivative product cleared through any derivatives clearing organization or other organized clearing house.

If a Winner is unreachable; does not make direct contact with Sponsor by the time specified by Sponsor, fails to provide Sponsor with any requested information or fails to submit a Sweepstakes Pick or accept the Prize, Sponsor reserves the right, in its sole and absolute discretion, to disqualify such Winner and to select a replacement Winner from the remaining qualifying participants. Sponsor shall not be responsible for failed attempts to notify the Winner and no responsibility is assumed by Sponsor for any correspondence returned as undeliverable or any other problems associated with attempt(s) to notify the Winners. Upon the request of Sponsor, the Winner must sign and return the following documents: an affidavit of eligibility; a liability/publicity release; and any other releases and waivers requested by Sponsor. If any of the foregoing documents are not completed, signed, and returned prior to deadline noted therein, or if a Winner is deemed by Sponsor to be ineligible or not to have complied with these Official Rules, then such Winner will be disqualified and an alternate Winner will be selected from the remaining eligible entries, time permitting.

In the event that a potential winner is disqualified for any reason, an alternate potential winner will be selected in a random drawing among all remaining eligible Entries. Sponsor will have complete discretion over interpretation of the Official Rules, of administration of the Sweepstakes, and of selection of the winners. Decisions of the Sponsor as to the selection of the winners will be final.

If the Winner selected the correct outcome in their Sweepstakes Pick submission, they will win the One Hundred Thousand Dollars ($100,000) prize (the “Prize”).

If applicable, a Sponsor representative will contact the Winner to coordinate the delivery of the Prize in a commercially reasonable time after Sunday, February 8, 2026. Prize recipients will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Prize received, regardless of whether the Prize, in whole or in part, is used. Prizes are non-transferable, with no equivalents or substitutions except at Sponsor’s sole and absolute discretion. All Prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion. Prize details and availability are subject to change and prize provider’s rules and restrictions, and in the event that Sponsor is unable to provide the winner with his or her Prize(s), the Sponsor may elect to provide winners with the approximate value of such item in cash or award an alternate prize of comparable or greater value. All Prizes are awarded “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). The approximate retail value (“ARV”) of the prizes is based on available information provided to Sponsor and the value of any prize awarded to a Winner may be reported for tax purposes as required by law. The Winners may be required to provide Sponsor with a valid social security number before the Prizes will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of Winners. Unclaimed Prize(s) will be forfeited. Prize(s), if legitimately claimed, will be awarded.  The Sweepstakes Entities are not responsible for and will not replace any lost, mutilated or stolen prizes or any prize that is undeliverable or does not reach the winner because of an incorrect or changed address. If a winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited, and the Sweepstakes Entities will have no further obligation with respect to that prize or portion of the prize. The Sweepstakes Entities are not responsible for, and winner will not receive the difference, in any, between the actual value of the prize(s) at the time of award and the stated ARV in these Official Rules or in any Sweepstakes-related correspondence or material. Limit of one (1) Prize per person in connection with this Sweepstakes.

6. Registration Procedures

To qualify for the Sweepstakes, eligible individuals must have an active FanDuel Predicts member account (“FanDuel Account”) and verify your identity in order to trade on FanDuel Predicts. Creating a FanDuel Account on the FanDuel Predicts mobile applications where available is free. By submitting your information and creating a FanDuel Account, however, participants will be required to agree to the FanDuel Predicts Privacy Policy and Terms.  If you do not agree to FanDuel Predicts’s Terms and Privacy Policy, you cannot create a FanDuel Account or participate in this Sweepstakes.

In addition to the eligibility requirements in Section 3, Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in any Sweepstakes for any reason, in its sole discretion, including based on your trading patterns or trading history or if you failed to take advantage of any previous Sweepstakes or promotion in good faith.  This Sweepstakes is void where prohibited by law.  There is a limit of 1 Entry per person. Limit of one (1) Prize per person.

Deposited funds that have not been played may be refunded at any time.

Should you wish to cancel your participation in this Sweepstakes at any time, please contact customer support at https://support.fanduel.com/s/. Upon cancellation, you may withdraw any real money funds you have deposited into your account without restriction.

Administration:  The Sponsor expressly reserves the right to amend, suspend or terminate this Sweepstakes at any time without prior notice or consent.  Administration of this Sweepstakes is at the sole discretion of the Sponsor.  Sponsor reserves the right to restrict at any time any FanDuel Account holder from participating in this Sweepstakes for any reason.  Any questions relating to eligibility, these Official Rules or any other questions concerning this Sweepstakes will be resolved at the sole discretion of the Sponsor and their decisions will be final and binding with respect thereto.  No groups, clubs, corporations, companies, partnerships, or organizations may participate in this Sweepstakes or reproduce or distribute any portion of these Official Rules to their members.

 

Release and Waiver of Liability:  By redeeming this Sweepstakes, participants agree to release, defend, indemnify and hold harmless the Sponsor, its affiliates, gaming license partners, advertising and promotion agencies, directors, officers, employees, representatives and agents from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with: (i) your participation in the Sweepstakes; and (ii) the receipt, use or misuse of the Prize, or while preparing for, participating in, and/or traveling to any Sweepstakes-related activity, including those damages caused by the Sponsor’s own negligence.  The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the Prize. Sponsor shall not be liable for any problems that occur during the entry process, including without limitation, late, incomplete, delayed, undelivered, ineligible, inaccurate, erroneous or misdirected entries, and shall not have any obligation to advise an entrant of an incomplete, invalid, or undeliverable submission. No illegible, incomplete, forged, or altered entries will be accepted. In consideration of the Prize, each individual hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of such individual’s name, photograph, likeness (including his/her voice), biographical information and statements concerning the Sweepstakes, in any and all advertising, promotions and other publicity conducted by the Sponsor and its affiliates. By participating in the Sweepstakes, the Winners agree to refrain from any behavior or communication that would harm the image or reputation of Sponsor or the Sponsor user community. YOU FURTHER ACKNOWLEDGE AND AGREE THAT YOUR PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING YOUR NAME ON A WINNER’S LIST.

No Third-Party Sponsor: This Sweepstakes is in no way sponsored, endorsed, or administered by, or in association with any person or other entity, including any third party, other than FanDuel.

Governing Law:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants and the Sponsor in connection with the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

 

Dispute Resolution: You agree that any claim or dispute that has arisen or may arise relating in any way to or arising out of the Sweepstakes, or these Terms will be resolved in accordance with the dispute resolution provisions set forth in the “Binding arbitration and class action waiver” Agreement (https://www.fanduel.com/predicts-arbitrationagreement).  This Agreement requires you to resolve disputes by binding arbitration and you agree to waive the ability to bring claims in a class action format. 

 

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE SPONSOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO REDEMPTION OF THE SWEEPSTAKES, EVEN IF FORESEEABLE OR EVEN IF THE SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

Miscellaneous:  No waiver of any of the provisions of these Official Rules shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided.  If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Official Rules, which will otherwise remain in full force and effect.

For any legally required winners’ list, send a self-addressed stamped envelope to Sponsor at Attn: Legal Department at 1 Madison Ave., New York, NY 10010. All such requests must be received within three (3) months after the end of the Sweepstakes.
