Welcome to the FanDuel Free Sportsrich Indiana Contest (“Tournament”). The Tournament is a free entry contest – no entry fee is required to participate. The Tournament is only available to participants residing within 150 miles of Bankers Life Fieldhouse, 125 South Pennsylvania Street, Indianapolis IN 46204. The Tournament will run on Tuesday, November 15, 2016.

Official Rules of the Free Sportsrich Indiana Contest

The Tournament is a single entry contest and no entry fee is required to enter. Any participant who registers more than one (1) account in order to gain more than one entry into the Tournament will be disqualified from the Tournament and potentially suspended from FanDuel. FanDuel will establish the maximum number of participants for the Tournament prior to the start of the Tournament.

The Tournament will consist of one (1) NBA fantasy contest using FanDuel’s standard rosters and scoring rules for NBA contests, available at https://www.fanduel.com/rules. The participants with the highest scores will win prizes based on their finishing position in the Tournament per the prizing table below. In the event of a tie in the highest score for determination of any prize winner, the tied participants will play a one-day “playoff' tournament”, which will be administered by FanDuel in its sole discretion, to determine finishing place position. Any “playoff tournament” will consist of a head-to-head or private league contest between the tied participants.

There will only be one (1) winner for each finishing place prize as shown within the prizing structure. All prizes are subject to availability. FanDuel reserves the right to substitute any prize or portion of a prize with a prize of equal or greater value. Unless specifically provided for in these Contest rules or otherwise specified in the prizing structure, each winner and his/her guest(s) will be solely responsible for all taxes, gratuities, meals, transportation, parking, lodging and any other costs and expenses incurred in participating in any Tournament and/or claiming or use of any prize, or portion thereof.

In order to participate in the Tournament, you must meet the following eligibility requirements. Any participant who does not meet all eligibility requirements will be disqualified by FanDuel in its sole discretion.

· You must be 18 years of age or older at the time of entry (21 years if residing in Massachusetts);

· You must be a US resident within 150 miles of Bankers Life Fieldhouse, 125 South Pennsylvania Street, Indianapolis IN 46204. Your residency will be determined based on your verified address as provided to FanDuel;

· You must have a current FanDuel account or register for a FanDuel account. There is no fee to register or participate in the Contest.

· You must comply with the entirety of FanDuel’s Terms of Use (www.fanduel.com/terms);

· You are not subject to backup withholding tax because:  (a) you are exempt from backup withholding, or (b) you have not been notified by the Internal Revenue Service (IRS) that you are subject to backup withholding as a result of a failure to report all interest or dividends, or (c) the IRS has notified you that you are no longer subject to backup withholding;

· At the time of entry, you must not be physically located in the state of Nevada.

Employees, officers, and directors of FanDuel, Pacers Basketball, LLC d/b/a Indiana Pacers, Pacers Sports & Entertainment and Home Court, the National Basketball Association (NBA) and their respective parents, affiliates, subsidiaries, limited liability companies, distributors, sales representatives, Web masters/suppliers, advertising and promotional agencies, and the immediate family members (spouse, children, parents, siblings) or household members (whether or not related) of each are not eligible to participate in the Tournament.

FanDuel may request US resident prize winners to provide address and social security details prior to receiving their prize if their prize exceeds $600 in value. Winners are responsible for paying all taxes, fees, registration and insurance, for any prizes won in connection with this contest.

By participating in the Free Sportsrich Indiana Contest, each entrant warrants that he/she is eligible to participate in this Tournament and has the legal capacity to agree to the terms and conditions contained in these Official Rules. Each participant/entrant agrees to release, indemnify, and hold harmless FanDuel, Pacers Basketball, LLC d/b/a Indiana Pacers, Pacers Sports & Entertainment and Home Court, the NBA and its Member Teams, NBA Properties Inc., and each of their respective parent, affiliates, subsidiaries, employees, advertising/promotions agencies, licensees, service providers, suppliers, and agents, (collectively, the “Released Parties”) from any and all liability, injuries, losses, or damages to any person (including death) or property, arising from or in connection with participation in the Tournament, the awarding, receipt, use and/or misuse of any prize or portion thereof, or participation in any prize-related activity of the Tournament. By participating in the Tournament, each participant/entrant agrees to waive any right to claim ambiguity in regard to the mechanics of the Tournament or the interpretation of these Official Rules. Solely for purposes of compliance with the terms and conditions provided in these Official Rules, any guest of a winner will be deemed as an “entrant/participant” in the Tournament, regardless of whether such guest submitted an official entry or participated in the Tournament. FanDuel reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you and, in such case, you agree to cooperate with FanDuel in the defense of such matter.

Released Parties are not responsible for lost, late, delayed, inaccurate, incomplete, or misdirected entries, or for electronic, network, computer, or phone failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer or phone transmissions that may limit a user’s ability to participate in this Tournament, or for other hardware, software or technical errors of any kind including any injury or damage to any person’s computer or phone related to or resulting from participating in the Tournament, or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, phone, network, typographical, printing or otherwise, relating to or in connection with the Tournament, including, without limitation, errors or difficulties which may occur in connection with the administration of the Tournament, the processing of entries, or with respect to any Tournament-related materials. This Tournament is subject to all applicable federal, state, and local laws. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Tournament will be declared ineligible and may be prosecuted.

By entering the Free Sportsrich Indiana Contest each participant grants full permission for any Released Party (as defined above) to broadcast and/or to photograph or publish such person’s name, voice, recorded comments, and likeness, worldwide in all media in perpetuity on a royalty-free basis, without payment or compensation of any kind, except as prohibited by law. Participants/winners also agree to speak to bloggers and other journalists and media personnel where applicable prior to, during and after the experience, and they agree to participate in additional FanDuel marketing activities, without additional payment or compensation of any kind. Participants agree to refrain from any behavior or communication that would harm the image or reputation of FanDuel, the Indiana Pacers, the NBA, or the FanDuel user community.

The decisions made by FanDuel regarding all aspects of the Free Sportsrich Indiana Contest, including but not limited to, eligibility, winners, scoring, travel arrangements, rules, prizes and compliance with the Affidavit of Eligibility are considered final.  FanDuel reserves the sole right to make reasonable changes to these Official Rules if necessary, (a) to ensure the fairness of competition, and (b) in response to unanticipated developments (such as technical failures, errors, acts of God, natural disasters, terrorism, changes in applicable law, interruption in the NBA season or schedule, failure of stats provider, failure of hotel provider, and failure to obtain a minimum number of entrants).  All participants will be also subject to FanDuel’s complete Terms of Use.  Any participant found in violation of any terms provided for herein or the Terms of Use may be disqualified by FanDuel at its sole discretion.
