The Promotion will consist of one (1) NFL fantasy football contest (“Featured Contest”), running on Sunday, January 13th, 2019. The Promotion will award prizes, based on a player’s score from the Featured Contest . The Featured Contest will be multi-entry and have a $5 entry fee. Each participant may submit a maximum of three (3) entries into the Featured Contest. Any instance of registering multiple accounts on FanDuel in order to gain more than the allowed three (3) entries into the Featured Contest will result in automatic disqualification from the Featured Contest and the Promotion, as well as potential suspension from FanDuel.

Prizes will be associated with finishing positions in the Featured Contest, as follows:

The player with the highest score in the Featured Contest (“Grand Prize Winner”) will be awarded with $2,500, two (2) tickets (for the Grand Prize Winner + guest) to Barstool’s Rough N Rowdy 7 , a $2,000 credit to cover travel expenses (“Travel Credit”), and a Barstool T-Shirt (“Grand Prize”). The Grand Prize includes a three (3) night stay at the Home2 Suites by Hilton Atlanta Downtown from February 1-4, 2019. Approximate retail value (“ARV”) of the Grand Prize is $7,000. Travel Credit for the Grand Prize Winner will be deposited in his/her account within 48 hours. The Grand Prize Winner is responsible for booking his/her flight accommodations with the Travel Credit. FanDuel will not provide more cash than initially deposited; the Grand Prize Winner will be responsible for any excess travel costs. The Grand Prize Winner also has the option to take the cash value of the tickets and Travel Credit ($2,200) in lieu of accepting the tickets and the Travel Credit (Barstool Merchandise and hotel credit is not redeemable for cash value). The Grand Prize Winner must submit this request in writing within 24 hours of being awarded the Grand Prize.

No transfer, assignment, cash redemption, or substitution of prizes (or portion thereof) is permitted, except by FanDuel who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value as determined by FanDuel.

Standard FanDuel fantasy football scoring rules apply to the Featured Contest and can be found here. In the event of a tie in the Featured Contest, the tied participants will play in a head to head or private league contest on Sunday, January 20th, 2019, as determined by FanDuel at their sole discretion.

All US and Canadian residents who are 18 years of age or older (21 in Massachusetts) and comply with our eligibility rules for paid entry games in our Terms of Use are eligible to win a prize as part of this Promotion. Users physically located in Alabama, Arizona, Hawaii, Idaho, Iowa, Louisiana, Montana, Nevada and Washington are not eligible to participate or earn rewards in this competition. FanDuel makes no representation that participation in paid entry fantasy sports contests is lawful under Texas state law. FanDuel employees may enter the competition for testing purposes but are not eligible to win any prizes. Barstool Sports employees and employees and operators of other daily fantasy sports sites are not eligible for this Promotion.

All US resident prize winners will be required to provide address and social security details prior to receiving their prize if their prize exceeds $600 in value. Winners are responsible for paying all taxes, fees, registration and insurance, for any prizes won in connection with this contest, including non-cash prizes.

By participating in the Promotion, each participant accepts and agrees to accept and be bound by these Terms and Conditions and by the decisions of FanDuel, which shall be final and binding in all respects. The decisions made by FanDuel management regarding, but not limited to, eligibility, winners, scoring, rules, prizes and compliance are, in accordance with FanDuel’s Terms of Use. No correspondence will be entered into. FanDuel reserves the right to make reasonable changes to these terms, (a) to ensure the fairness of competition, (b) for clarification purposes or to correct any such ambiguity or error(s) and (c) in response to unanticipated developments (such as technical failures, errors, acts of God, natural disasters, terrorism, changes in applicable law, interruption in the NFL season, failure of stats provider, and failure to obtain a minimum number of entrants). In the event that the Promotion is challenged by any legal or regulatory authority, Released Parties reserve the right to discontinue or modify the Promotion, or to disqualify participants residing in the affected geographic areas. In such event, FanDuel shall have no liability to any participants who are disqualified due to such an action.

FanDuel may require prize winners to sign an Affidavit of Eligibility to confirm their identity and eligibility for the Promotion. Failure to return the Affidavit of Eligibility at FanDuel’s request may result in disqualification from the Promotion and any related contests.

In consideration for the opportunity to participate in the Promotion, and other good and valuable consideration, the receipt of which is hereby acknowledged, I agree as follows:

• I represent that I am over 18 years of age (21 in MA). I agree hereby to provide government-issued photo identification to FanDuel to verify my identity and date of birth.
• I represent that I am not an employee or operator of another daily fantasy site that charges entrance fees or offers cash prizes. Further, I represent that I do not, by virtue of affiliation with another daily fantasy site, have access to the site’s pre-release non-public confidential data about contest-related information.
• I reaffirm my agreement to:
• The FanDuel Terms of Use, provided at (https://www.fanduel.com/terms); and
• The Promotion rules, provided at FanDuel.com/stillhere
• I agree to refrain from any behavior or communication during the promotion that would harm the image or reputation of FanDuel, NFL, Barstool Sports, David Portnoy, or the FanDuel user community.
• I agree that FanDuel and its service providers may use my name, any biographical information that I provide to FanDuel, image, likeness, photo, and voice for advertising, publicity, and promotional purposes without additional notice or compensation.
• FanDuel and its partners, sponsors and affiliates, may take photos or videos of me or in which I appear (“Images”) during the events and activities described in this Affidavit of Eligibility. I grant FanDuel ownership of any copyright or other rights I may have in the Images. I grant FanDuel an irrevocable, perpetual and unrestricted right to publish, distribute, copy, perform and otherwise use in any manner the Images and derivative works thereof, in conjunction with my own or a fictitious name, or without any name, in any medium, and in all media now or hereafter known, including over the Internet, for promotion, advertising, trade or commerce, or for any other purpose whatsoever. I also grant FanDuel an irrevocable, perpetual and unrestricted right to publish and otherwise use my name for such purposes, whether or not in connection with the Images. I consent to the digital compositing or distortion of the Images, including any changes or alterations as to color, size, shape, perspective, context, foreground or background or associated audio. I also consent to the use of any published matter in conjunction with such Images. I waive any right that I may have to inspect or approve the finished product or products and the advertising copy or other matter that may be used in connection with the Images or my name or the use to which they may be applied. I release and discharge FanDuel and assigns from any liability in connection with their use of the Images or my name, including without limitation any claims for libel or violation of any right of publicity or privacy. FanDuel, Barstool and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, representatives, and agents shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation, personal injury or death to me or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by any reason, including the acceptance, possession, use or misuse of the Grand Prize and/or participation in this Promotion. This grant of rights is binding upon me and my heirs, estate, legal representatives, and assigns.
