Terms and Conditions

EFFECTIVE DATE: May 22, 2025

PLEASE READ THESE TERMS OF USE CAREFULLY. THESE TERMS OF USE SET FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR PARTICIPATION IN THE PROGRAM (DEFINED BELOW) AND REDEMPTION OF REWARDS (DEFINED BELOW).

ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND YOU WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

Welcome to the FanDuel VIP Rewards Program (the “Program”), where invited FanDuel VIP members will receive gifts and/or benefits (collectively, “Rewards”) from Betfair Interactive US LLC and/or ODS Technologies, L.P. (“FanDuel,” “we,” “us,” or “our”) for being part of the FanDuel VIP community. The terms “you,” “your,” “participant” and “recipient” mean the person who participates in this Program and/or accepts Rewards. Participation in the Program and/or acceptance of Rewards is expressly conditioned upon acceptance of and compliance with all of these Program “Terms and Conditions.” By participating in this Program and/or accepting Rewards, you also understand and agree to be, and are, bound by the following: FanDuel’s Terms of Use, FanDuel’s Privacy Policy, FanDuel’s House Rules for the applicable FanDuel platform, and any other applicable terms and conditions posted by FanDuel, which are incorporate herein by reference. Your participation in the Program and/or acceptance of Rewards also constitutes your acceptance of any modifications to these Terms and Conditions. You must be at least twenty-one (21) years of age (or at least eighteen (18) years of age, if located in the District of Columbia) to participate in the Program and redeem Rewards.

I. Rewards Terms and Conditions

For Rewards that consist of items, tickets to a game or event, Sportsbook Bonus Bets (defined below) or Casino Site Credit (defined below), the below terms and conditions apply:

Items Delivered Through Postal: If you received a Reward via FanDuel’s gifting platform, Postal, you will receive a link via email to the email address associated with your FanDuel account or as otherwise provided to you by FanDuel. You must fill out and submit all required information requested by Postal in the requested timeframe for your Reward to be physically delivered to you by Postal. If you provide a P.O. Box, you may be required to provide an alternative address and this may cause a delay in delivery, so use of a P.O. Box is discouraged. Your Reward will be mailed to the physical address provided by you to Postal within a commercially reasonable period of time after you provide an acceptable mailing address to Postal. Postal will only mail the Reward to an address located in the contiguous United States, excluding Alaska and Hawaii. Reward items are non-refundable once shipped. Notwithstanding the foregoing, occasionally you may receive a “surprise” Reward via Postal, in which case you will not receive an email with a link. However, the Postal terms and conditions will apply to those Rewards as well.

Items delivered through Postal are subject to the terms and conditions provided by the item provider; please see terms and conditions of item provider for more information. You must be twenty-one (21) years of age or older to redeem certain Rewards, such as alcohol products, and may be required to provide proof of age and location to Postal or the item provider.

Other Items: If the Reward is a motorized vehicle or watercraft of any kind, including, without limitation, a car, motorcycle, off-road vehicle, boat, jet ski, or otherwise (“Vehicle”), the following will apply, to the extent applicable: you must be a licensed driver and must present a current valid U.S. driver's or boating license and proof of insurance prior to taking possession of the Vehicle, and failure to show the same may result in Reward forfeiture or substitution. You are responsible for all associated dealership fees including all title, license, insurance, registration, dealer preparation, applicable taxes or fees, destination and handling charges, and other fees associated with the Vehicle, including any travel and transportation costs associated with collecting the Vehicle. All other costs not specifically stated as being awarded by FanDuel are your responsibility. You may be required to take delivery of Vehicle from a designated authorized dealer within thirty (30) days after the date the Vehicle is delivered to the specified designated dealer, or the Vehicle may (in FanDuel's sole discretion) be automatically forfeited by you. Otherwise, the Vehicle will be delivered directly to you from FanDuel at a location and on a date selected by FanDuel in its sole and absolute discretion. Except as stated in the manufacturer’s limited warranty for the Vehicle, none of FanDuel or any other person associated with the manufacture, distribution, development and provision or delivery of the Vehicle, or any of their respective affiliates, parent companies, subsidiaries, directors, officers, employees, and agents makes any warranties, representations or guarantees, express or implied, in fact or in law, relative to the use or enjoyment of the Vehicle, including, without limitation, its quality, mechanical condition, merchantability or fitness for a particular purpose. Any and all guarantees and warranties for the Vehicle are subject to the manufacturer’s terms and conditions, and you agree to look solely to such manufacturers for any such warranty or guarantee claim.

Tickets for Games, Events and Experiences: If you receive a Reward consisting of ticket(s) to a game,event or experience, and, for whatever reason, the game, event or experience associated with your Reward is cancelled after such Reward is provided to you, FanDuel’s liability for the Reward is limited only to the non-game/event/experience portions of the Reward. No compensation will be paid in lieu of a cancelled game, event or experience. Tickets to games or events are subject in all respect to the terms and conditions set forth on the tickets and any requirements of the facility hosting the event, and FanDuel disclaims any liability in connection with such terms and conditions and requirements, including, but not limited to, any facility or Reward provider restrictions in honoring the tickets associated with the Reward. Seat locations (if applicable) will be determined by FanDuel in its sole and absolute discretion. You are strictly prohibited from selling, auctioning, trading or otherwise transferring the tickets unless FanDuel consents in writing beforehand. In the event that you (and/or your companion(s), if applicable) engage in behavior that (as determined by FanDuel, the game/event venue or the Reward provider in its or their sole and absolute discretion) is obnoxious, inappropriate, threatening or illegal or that is intended to annoy, abuse, threaten or harass any other person, FanDuel reserves the right to terminate the applicable experience early. Decisions regarding your and any of your companion’s conduct, in all aspects of your and any companion’s participation in any Reward-related game/activity/event/experience, will be in the sole discretion of FanDuel and any of FanDuel’s representatives, and will be final and binding in all respects. You and your companion(s) may be removed or disqualified from participating in any aspect of the Reward for any reason at any time, including, without limitation, creating an unauthorized disturbance, interruption or unnecessarily rough physical contact, creating the potential for injury or property damages or for any unhealthy, unsafe, unlawful or inappropriate act. If you or your companion(s), in the opinion of FanDuel or any of FanDuel’s representatives, is considered a physical or mental threat to the well-being of any other individual, you and/or your companion(s) may be removed from any premises relating to the Reward and the you consent to such removal. You and your companion(s) must abide by all applicable venue policies including any rules and regulations related to COVID-19. Tickets for games and events are subject to the terms and conditions provided by the Reward provider, league or team; please see terms and conditions on or accompanying the tickets for more information. You may be required to have a third-party ticket account active, such as Ticketmaster or Tickets.com, to receive your game or event tickets.

Travel and Attendance at Certain Types of Events and Receipt of Other Certain Items: If you are provided with the opportunity to receive a Reward involving travel or attendance at certain types of events or consisting of certain items, including, without limitation, a Vehicle, you and any companion(s) may be required to submit an affidavit of eligibility/release of liability agreement (collectively, the “Affidavit”) and return the Affidavit within the time period specified at notification before being eligible to receive the Reward. If you fail or refuse to sign and return such Affidavit within the time period required by FanDuel, you will not be able to receive the applicable Reward.

FanDuel Sportsbook Bonus Bets: Rewards may be provided as bonus bets for use only on the FanDuel Sportsbook app (“Sportsbook Bonus Bets”). Any wagering or market requirements, expiration or other restrictions of the Sportsbook Bonus Bets you receive will be communicated to you by FanDuel.

FanDuel Sportsbook Tokens: Rewards may be provided as tokens for use only on the FanDuel Sportsbook app (“Sportsbook Tokens”). Any wagering or market requirements, expiration or other restrictions of the Sportsbook Tokens you receive will be communicated to you by FanDuel.

FanDuel Casino Bonus: Rewards may be provided as bonuses for use only on FanDuel Casino (“Casino Bonus”). For more information on Casino Bonus, please see: https://casino.fanduel.com/. Any wagering or game play requirements, expiration or other restrictions of the Casino Bonus you receive will be communicated to you by FanDuel.

FanDuel Casino Bonus Spins: Rewards may be provided bonus spins for use only on FanDuel Casino (“Casino Bonus Spins”). Any wagering, game type or location requirements, expiration or other restrictions of the Casino Bonus Spins you receive will be communicated to you by FanDuel.

DFS Bonus Cash & Contest Vouchers: Rewards may be provided as bonus cash or contest vouchers for use only on the FanDuel Fantasy product (“DFS Bonus Cash & Vouchers”). Any entry requirements, expiration or other restrictions of the DFS Bonus Cash & Vouchers you receive will be communicated to you by FanDuel.

II. General Terms and Conditions Applicable to All Rewards

Rewards General Terms: Rewards are non-transferable, with no equivalents or substitutions except at FanDuel’s sole and absolute discretion. All Rewards details not specified in these Terms and Conditions will be determined in FanDuel’s sole and absolute discretion. Rewards details and availability are subject to change and rules and restrictions, and in the event that FanDuel is unable to provide the recipient with their Rewards, FanDuel may elect to provide recipient with the approximate value of such Rewards in cash or provide an alternate offering of comparable or greater value, in its sole and absolute discretion. Rewards are delivered “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). The approximate retail value (“ARV”) of a Reward is based on available information provided to FanDuel. Unclaimed Rewards will be forfeited. FanDuel is not responsible for and will not replace any lost, mutilated or stolen Rewards or any Rewards that are undeliverable or do not reach the recipient because of incorrect or changed FanDuel account information or other recipient information. FanDuel is not responsible for and recipients will not receive any difference between the actual value of a Rewards at the time of award and the stated ARV in any Program-related correspondence or material. Certain restrictions and blackout dates may apply to the Rewards or delivery of the Rewards. You must redeem or take delivery of the Reward within the timeframe communicated to you by FanDuel, otherwise your Reward may be forfeited. FanDuel is not responsible for any cancellations, diversions or delays in shipping by or through Postal or any other third-party carrier or company.

Those who do not abide by these Terms and Conditions or other instructions of FanDuel may be disqualified or removed from the Program, at FanDuel’s sole and absolute discretion. In the event a participant engages in behavior that is obnoxious, inappropriate, threatening or illegal or that is intended to annoy, abuse, threaten or harass any other person, FanDuel reserves the right to terminate the individual’s participation in the Program and/or redemption of Rewards. Subsequent attempts made by the same individual to participate in the Program using multiple or false contact information, accounts or otherwise may result in the participant being disqualified. Activity created by a script, computer programs, macro, programmed, robotic or other automated means may result in the participant being disqualified. No illegible, incomplete, forged or altered information will be accepted. Participants who do not meet the eligibility requirements (including all requirements with respect to age and location) are ineligible to participate in the Program and redeem Rewards. All materials submitted for the Program become the physical property of FanDuel and will not be returned. Those who do not follow all of the instructions, provide any required information to redeem the Rewards or abide by these Terms and Conditions or other instructions of FanDuel may be disqualified. In the event of a dispute as to the identity of any participant, the participant’s identity will be determined by the registered account holder of the FanDuel account or email used to register for the Program, but only if such person is otherwise eligible. The “registered account holder” is the person assigned a username or email address by the entity responsible for assigning it (e.g., FanDuel). Participants may be required to show proof of being the registered account holder. If a dispute cannot be resolved to FanDuel’s satisfaction, the participant will be deemed ineligible. FanDuel reserves the right to refuse or otherwise restrict your eligibility to participate in this Program for any reason, in our sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous promotion in good faith.

Tax Matters: You are solely responsible for all federal, state and local taxes, and for any other fees or costs associated with the Rewards received, regardless of whether the Rewards, in whole or in part, are used. You may be required to provide FanDuel with a valid Social Security number and/or an IRS Form W-9 or equivalent before a Reward will be gifted to you. FanDuel may be required by law to report Rewards to the IRS and other governmental agencies for tax and/or regulatory purposes. The value of Rewards reported for these purposes per IRS rules may or may not be equal to the ARV of the Rewards.

Administration of Program: FanDuel expressly reserves the right to amend, suspend or terminate this Program at any time without prior notice or consent. Administration of this Program is at the sole discretion of FanDuel. FanDuel reserves the right to restrict at any time any person from participating in this Program for any reason. FanDuel expects all Program participants to treat FanDuel’s employees, representatives and agents with dignity and respect. Any behavior to the contrary is not welcome and may result in your termination from the Program. In the event FanDuel is prevented from continuing with the Program by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Program by any party, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within FanDuel’s control (each, a “Force Majeure” event or occurrence), FanDuel shall have the right to modify, suspend or terminate the Program. FanDuel additionally reserves the right, in its sole and absolute discretion: (i) to modify, suspend or terminate the Program should a Force Majeure event or occurrence corrupt or interfere with the administration, integrity, operation, security or proper play of the Program; or (ii) to disqualify any participant found to be, or suspected of: (a) tampering with the entry process or the operation of the Program; (b) acting in violation of these Terms and Conditions; or (c) acting in an unsportsmanlike manner.

Any questions relating to eligibility, these Terms and Conditions or any other questions concerning this Program will be resolved at the sole discretion of FanDuel and its decisions will be final and binding with respect thereto. No groups, clubs, corporations, companies, partnerships or organizations may reproduce or distribute any portion of these Terms and Conditions to their members.

Release, Indemnity and Waiver of Liability: By participating in this Program, you agree to release, defend, indemnify and hold harmless FanDuel and its parent companies, affiliates, subsidiaries, cable/satellite affiliates, advertising and promotion agencies, Rewards providers, retailers and distributors, and each of their directors, officers, employees, representatives and agents (collectively, the “Released Parties”) from and against any and all liability claims, actions, costs (including attorneys’ fees) of any kind whatsoever (however named or described) for injuries, death, damages or losses in connection with: (i) your participation in the Program; (ii) the receipt, use or misuse of any Rewards, or while preparing for, attending, participating in, and/or traveling to any Rewards-related activity, event, game or experience, including those damages caused by FanDuel’s own negligence; (iii) compliance with any FanDuel or Rewards provider terms of service, code of conduct or similar terms and conditions; (iv) the Released Parties’ actual or alleged violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or claims of infringement of intellectual property or other rights; and (v) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Program activity or Rewards. FanDuel expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of any Rewards.

No Third-Party Affiliation: This Program is in no way sponsored or endorsed by, or affiliated with, any person or other entity, including any third party, other than FanDuel. References to third parties are for reference and identification purposes only and are not intended to suggest sponsorship, endorsement or affiliation with FanDuel or the Program.

Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations of recipients and FanDuel in connection with the Program will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

Dispute Resolution: You agree that any claim or dispute that has arisen or may arise relating in any way to or arising out of the Program or these Terms and Conditions will be resolved in accordance with the dispute resolution provisions set forth in the “Binding Arbitration and Class Action Waiver” Section of the FanDuel Terms of Use. This “Binding Arbitration and Class Action Waiver” of the FanDuel Terms of Use requires you to resolve disputes by binding arbitration and you agree to waive the ability to bring claims in a class action format.

LIMITATION OF LIABILITY: BY PARTICIPATING IN THIS PROGRAM, YOU AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (I) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROGRAMOR OR ANY PROGRAM BONUS REDEEMED WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (II) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (III) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND PARTICIPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (IV) PARTICIPANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

Miscellaneous: No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect. Participants agree to waive any rights to claim ambiguity of these Terms and Conditions. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Program-related materials, privacy policy or terms of use on any website, social media platform or application and/or the terms and conditions of these Terms and Conditions, these Terms and Conditions shall prevail, govern and control and the discrepancy will be resolved in FanDuel’s sole and absolute discretion.
