TERMS & CONDITIONS

  • VOID WHERE PROHIBITED BY LAW.
  • CERTAIN REWARDS (DEFINED BELOW) ARE AVAILABLE ON A FIRST-COME, FIRST-SERVED, WHILE SUPPLIES LAST BASIS.
  • THESE TERMS AND CONDITIONS GOVERN ALL ASPECTS OF PARTICIPATION IN THE PROGRAM AND REWARDS.
  • ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

1. Description of Program

Welcome to FanDuel Sportsbook Rewards Club Beta (the “Program”), where participants will have an opportunity to receive Rewards by participating in the “FanDuel Sportsbook Rewards Club,” a limited-time rewards platform, on the FanDuel Sportsbook app. 

The Program is sponsored by Betfair Interactive US LLC (“FanDuel” or “Sponsor”), located at 9000 Wilshire Blvd., 2nd Floor, Beverly Hills, CA 90211. The terms “you” or “your” mean the person who participates in this Program. Participation in the Program is expressly conditioned upon acceptance of and compliance with all of these Program “Terms and Conditions.” Program participants may be required to sign paperwork issued by Sponsor.

2. Program Period 

The Program begins at 12:00 A.M. Eastern Time (“ET”) on July 1, 2026 and ends at 11:59 p.m. ET on August 31, 2026 (“Program Period”). 

3. Eligibility

The Program is only open to individuals who (i) are at least twenty 21 years of age (18+ in D.C., Kentucky, and Wyoming) and are physically located in the States of Arizona, Arkansas, Colorado, Connecticut, the District of Columbia, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana (excluding the following parishes: Caldwell, Catahoula, Franklin, Jackson, LaSalle, Sabine, Union, West Carroll and Winn), Maryland, Massachusetts, Michigan, Missouri, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Tennessee, Vermont, Virginia, West Virginia, or Wyoming, (ii) have an active FanDuel Account in good standing and are not on an exclusion list or suspended, in a time out, etc. on their FanDuel Account, (iii) received an invitation to participate in the Program directly from Sponsor, and (iv) otherwise comply with these Terms and Conditions. Any individual who does not comply with all of the aforementioned eligibility requirements (and any other eligibility requirement set forth in these Terms and Conditions) will be disqualified from the Program and will forfeit the right to participate in the same and to receive Rewards, as determined by Sponsor in its sole discretion. Employees, officers and directors of Sponsor and its parent companies, affiliates, subsidiaries, cable/satellite affiliates, advertising and program agencies, Rewards providers, retailers, distributors (collectively, “Program Entities”), and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Program or receive Rewards. For purposes of this Program, “immediate family members” are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren and “those living in the same household” shall mean people who share the same residence at least three (3) months a year, whether legally related or not. Individuals who have entered any self-limited or government agency self-exclusion program or have been otherwise excluded from casinos by a government agency, Sponsor or one of its affiliates or gaming license partners and persons on a Disassociated Patrons, Self-Limit, Involuntary Exclusion, Voluntary Exclusion or Self Exclusion List in jurisdictions which Sponsor or its affiliates or gaming license partners operate are not eligible to participate in the Program or receive Rewards. Void where prohibited by law. For the avoidance of doubt, Sponsor will disqualify or remove those individuals who participate in this Program but are not in compliance with these Terms and Conditions, in accordance with these Terms and Conditions.

4. Action Required

To participate in this Program, during the Program Period, an eligible individual who received an invitation by Sponsor must first follow the instructions in the invitation, including logging into the FanDuel Sportsbook app using their FanDuel Account email and password. Then, make and settle one or more real money wagers equal to or greater than one dollar ($1) in value on any of Sponsor’s sportsbook markets during the Program Period to earn points. You can then, access the FanDuel Sportsbook Rewards Club page on the FanDuel Sportsbook app (the “Program Page”) to receive Rewards automatically, as described in Section 5 below. For clarity, if you do not agree to these Terms and Conditions for the FanDuel Sportsbook Rewards Club platform, you may not participate in this Program and will not receive any Rewards.


Sponsor’s database clock will be the official timekeeper for the Program. Those who do not follow all of the instructions, provide the required information in their registration form or abide by these Terms and Conditions or other instructions of Sponsor may be disqualified at Sponsor’s sole and absolute discretion. In the event a participant engages in behavior that is obnoxious, inappropriate, threatening or illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the individual’s participation in the Program early.

Subsequent attempts made by the same individual to participate in the Program using multiple or false contact information, accounts or otherwise may result in the participant being disqualified. Activity created by a script, computer programs, macro, programmed, robotic or other automated means may result in the participant being disqualified. No illegible, incomplete, forged or altered information will be accepted. Participants who do not meet the eligibility requirements (including all requirements with respect to age and location) are void. All materials submitted become the physical property of Sponsor and will not be returned. Those who do not follow all of the instructions, provide the required information in any registration form, or abide by these Terms and Conditions or other instructions of Sponsor may be disqualified. 

In the event of a dispute as to the identity of any participant, the participant’s identity will be determined by the registered account holder of the email or FanDuel Account used to register for the Program, but only if such person is otherwise eligible. The “registered account holder” is the person assigned an email address or username by the entity responsible for assigning it (e.g., FanDuel). Participants may be required to show proof of being the registered account holder. If a dispute cannot be resolved to Sponsor’s satisfaction, the participant will be deemed ineligible.

5. Claiming Program Rewards

Upon accepting these Terms and Conditions and placing and settling one or more real money wagers on any of Sponsor’s sportsbook markets as described in Section 4 above, participants will earn points at the following rates: 

Sportsbook Wager Odds and Points Earned:

  • Settled wagers with final odds between and including -1000 and -201:
    1. one (1) point for every One Dollar ($1) in total wagered, awarded on bet settlement
  • Settled wagers with final odds between and including -200 and +199:
    1. two (2) points for every One Dollar ($1) in total wagered, awarded on bet settlement
  • Settled wagers with final odds between and including +200 and +999:
    1. four (4) points for every One Dollar ($1) in total wagered, awarded on bet settlement
  • Settled wagers with final odds between and including +1000 and +3999:
    1. five (5) points for every One Dollar ($1) in total wagered, awarded on bet settlement
  • Settled wagers with final odds equal to or greater than +4000:
    1. six (6) points for every One Dollar ($1) in total wagered, awarded on bet settlement

 

For the avoidance of doubt, no points are earned on wagers placed on the FanDuel Sportsbook with final odds shorter than -1000 or that are equal to or less than ninety-nine cents ($0.99) in value. Further, the amount of points you earn per bet is the rounded-down figure after applying the odds-based multiplier to your wager. For example, in the event you placed and settled a four dollar seventy five cents ($4.75) wager with final odds equal to -300, you would earn four points for such wager ($4.75x1=4.75, then rounded down to 4 points). Rate at which points are earned are determined by FanDuel and are subject to change at FanDuel’s sole discretion. For more information about point earn rate, please contact FanDuel Support.

During the Program Period, the number of points you earn will be tallied up and rounded down to the nearest point. Based on the number of points you accumulate in a calendar month (which begins at 12:00 AM ET on the first day of such month and ends at 11:59 PM ET on the final day of such month), you will unlock a level within the FanDuel Sportsbook Rewards Club (“Monthly Level”). The following are the Monthly Levels and the monthly points required to earn Monthly Level:

FanDuel Sportsbook Rewards Club Level and Monthly Points Required:

  • Level 1:
    1. 0-799 points
  • Level 2:
    1. 800-7,999
  • Level 3:
    1. 8,000-27,999
  • Level 4:
    1. 28,000 and above
  • VIP:
    1. By invitation only

The set of Rewards you are eligible for in a month (beginning at 12:00 AM ET of the first day of such month) will be defined based on the amount of earned points you accumulate in the prior month by 11:59 p.m. ET on the last day of the prior month. If you earn enough points in a month to qualify for a higher Monthly Level than the current Monthly Level you are in for such month, you will be considered such higher Monthly Level for the rest of the then current month (in addition to qualifying such higher Monthly Level for the following month). During the remainder of such month, you will only be eligible to receive the Rewards from such higher Monthly Level that have not already been distributed for such higher Monthly Level that month (e.g., if your Monthly Level for July is Level 2 and you earn enough points in July on July 10th to qualify for a Level 3 Monthly Level for August, you will be eligible to receive any Level 3 Rewards distributed after July 10th for the remainder of July). 

Based on the FanDuel Sportsbook Rewards Club level you attain you may be eligible for the following gifts/rewards (each, a “Reward” and collectively, “Rewards”) as described on the Program Page:

Level 1 Reward and Approximate Retail Value (“ARV”):

  • A User Birthday Reward– FanDuel Sportsbook generosity provided on or around the birthday associated with the participant’s FanDuel Account (“User Birthday Reward”). User Birthday Reward must be claimed on participant’s Program Page within seven days of the birthday associated with the participant’s FanDuel Account. Sponsor is not responsible for errors in the birthday date. Any profit boost token, available for use only on the FanDuel Sportsbook (“Profit Boost Token”), bonus bets, available for use only on the FanDuel Sportsbook (“Sportsbook Bonus Bet”), or bet reset token, available for use only on the FanDuel Sportsbook (“Bet Reset Token”), awarded in a User Birthday Reward will expire seven (7) days after being made available to claim. Monthly Level of User Birthday Reward is distributed at is the Monthly Level you most frequently earned in the twelve months prior to the distribution of the Birthday Reward. (see Program Page and the direct communications you received from Sponsor notifying you that you have a User Birthday Reward to claim for more details, including any wagering or game play requirements, percentages, expiration or other restrictions on a User Birthday Reward).
  • Any available FanDuel Sportsbook Rewards Club promotions as described on the FanDuel Sportsbook Rewards Club platform (see Program Page for more details).
  • One monthly “Level 1” click-to-redeem “Wildcard Reward” offer containing Profit Boost Tokens, Bet Reset Tokens or Sportsbook Bonus Bets (each, a “Monthly Wildcard”). Each Monthly Wildcard will be claimable by you on your Program Page and must be claimed, at a minimum, within one (1) day of appearing on your Program Page, but such time period may be made longer at Sponsor’s discretion and as communicated directly to you by Sponsor. Any Profit Boost Token, Bet Reset Token, or Sportsbook Bonus Bets contained within a Monthly Wildcard will expire, at a minimum, seven (7) days after being claimed, but such time period may be made longer at Sponsor’s discretion and as communicated directly to you by Sponsor. (see Program Page for more details, including any wagering or game play requirements, token percentages, expiration or other restrictions on a Monthly Wildcard)

Level 2 Reward and ARV:

  • A User Birthday Reward.  User Birthday Reward must be claimed on participant’s Program Page within seven days of the birthday associated with the participant’s FanDuel Account. Sponsor is not responsible for errors in the birthday date. Any Profit Boost Tokens, Sportsbook Bonus Bets or Bet Reset Tokens awarded in a User Birthday Reward will expire seven (7) days after being made available to claim. Monthly Level of User Birthday Reward is distributed at is the Monthly Level you most frequently earned in the twelve months prior to the distribution of the Birthday Reward.  (see Program Page and the direct communications you received from Sponsor notifying you that you have a User Birthday Reward to claim for more details, including any wagering or game play requirements, percentages, expiration or other restrictions on a User Birthday Reward)
  • Any available FanDuel Sportsbook Rewards Club promotions and “Level 2 Exclusive” FanDuel Sportsbook Rewards Club promotions as described on the FanDuel Sportsbook Rewards Club platform (see Program Page for more details).
  • Weekly “Level 2” Choose-Your-Own-Reward – During any Program Week, you will receive a choice of Rewards, each available for use only on the FanDuel Sportsbook (each a “Weekly Reward”). To claim your Weekly Reward, you must, during a Program Week, open your Program Page and choose between the options presented for your Weekly Reward. Your Weekly Reward must be claimed and used by the completion of the Program Week in which it is made available to you. (see Program Page for more details, including any wagering or game play requirements, token percentages, expiration or other restrictions on a Weekly Reward)
  • One “Level 2” Monthly Wildcard offer. Each Monthly Wildcard will be claimable by you on your Program Page and must be claimed, at a minimum, within one (1) day of appearing on your Program Page, but such time period may be made longer at Sponsor’s discretion and as communicated directly to you by Sponsor. Any Profit Boost Token, Bet Reset Token, or Sportsbook Bonus Bets contained within a Monthly Wildcard will expire, at a minimum, seven (7) days after being claimed, but such time period may be made longer at Sponsor’s discretion and as communicated directly to you by Sponsor. (see Program Page for more details, including any wagering or game play requirements, token percentages, expiration or other restrictions on a Monthly Wildcard)

 

Level 3 Reward and ARV:

  • A User Birthday Reward.  User Birthday Reward must be claimed on participant’s Program Page within seven days of the birthday associated with the participant’s FanDuel Account. Sponsor is not responsible for errors in the birthday date. Any Profit Boost Tokens, Sportsbook Bonus Bets or Bet Reset Tokens awarded in a User Birthday Reward will expire seven (7) days after being made available to claim. Monthly Level of User Birthday Reward is distributed at is the Monthly Level you most frequently earned in the twelve months prior to the distribution of the Birthday Reward.  (see Program Page and the direct communications you received from Sponsor notifying you that you have a User Birthday Reward to claim for more details, including any wagering or game play requirements, percentages, expiration or other restrictions on a User Birthday Reward)
  • Any available FanDuel Sportsbook Rewards Club promotions and “Level 3 Exclusive” FanDuel Sportsbook Rewards Club promotions as described on the FanDuel Sportsbook Rewards Club platform (see Program Page for more details).
  • Weekly “Level 3” Choose-Your-Own-Reward – During any Program Week, you will receive a Weekly Reward. To claim your Weekly Reward, you must, during a Program Week, open your Program Page and choose between the options presented for your Weekly Reward. Your Weekly Reward must be claimed and used by the completion of the Program Week in which it is made available to you. (see Program Page for more details, including any wagering or game play requirements, token percentages, expiration or other restrictions on a Weekly Reward)
  • One “Level 3” Monthly Wildcard offer. Each Monthly Wildcard will be claimable by you on your Program Page and must be claimed, at a minimum, within one (1) day of appearing on your Program Page, but such time period may be made longer at Sponsor’s discretion and as communicated directly to you by Sponsor. Any Profit Boost Token, Bet Reset Token, or Sportsbook Bonus Bets contained within a Monthly Wildcard will expire, at a minimum, seven (7) days after being claimed, but such time period may be made longer at Sponsor’s discretion and as communicated directly to you by Sponsor. Level 4 Reward and ARV:

  • A User Birthday Reward.  User Birthday Reward must be claimed on participant’s Program Page within seven days of the birthday associated with the participant’s FanDuel Account. Sponsor is not responsible for errors in the birthday date. Any Profit Boost Tokens, Sportsbook Bonus Bets or Bet Reset Tokens awarded in a User Birthday Reward will expire seven (7) days after being made available to claim. Monthly Level of User Birthday Reward is distributed at is the Monthly Level you most frequently earned in the twelve months prior to the distribution of the Birthday Reward.  (see Program Page and the direct communications you received from Sponsor notifying you that you have a User Birthday Reward to claim for more details, including any wagering or game play requirements, percentages, expiration or other restrictions on a User Birthday Reward)
  • Any available FanDuel Sportsbook Rewards Club promotions and “Level 4 Exclusive” FanDuel Sportsbook Rewards Club promotions as described on the FanDuel Sportsbook Rewards Club platform (see Program Page for more details).
  • Weekly “Level 4” Choose-Your-Own-Reward – During any Program Week, you will receive a Weekly Reward. To claim your Weekly Reward, you must, during a Program Week, open your Program Page and choose between the options presented for your Weekly Reward. Your Weekly Reward must be claimed and used by the completion of the Program Week in which it is made available to you. (see Program Page for more details, including any wagering or game play requirements, token percentages, expiration or other restrictions on a Weekly Reward)
  • One “Level 4” Monthly Wildcard offer.  Each Monthly Wildcard will be claimable by you on your Program Page and must be claimed, at a minimum, within one (1) day of appearing on your Program Page, but such time period may be made longer at Sponsor’s discretion and as communicated directly to you by Sponsor. Any Profit Boost Token, Bet Reset Token, or Sportsbook Bonus Bets contained within a Monthly Wildcard will expire, at a minimum, seven (7) days after being claimed, but such time period may be made longer at Sponsor’s discretion and as communicated directly to you by Sponsor.   • The opportunity to enter weekly “Level 4 Exclusive” Sportsbook Sweepstakes. Opt-in required to participate.  (see Program Page for more details)

VIP Level Reward and ARV:

  • A User Birthday Bonus.  User Birthday Reward must be claimed on participant’s Program Page within seven days of the birthday associated with the participant’s FanDuel Account. Sponsor is not responsible for errors in the birthday date. Any Profit Boost Tokens or Bet Reset Tokens awarded in a User Birthday Reward will expire seven (7) days after being made available to claim. Monthly Level of User Birthday Reward is distributed at is the Monthly Level you most frequently earned in the twelve months prior to the distribution of the Birthday Reward.  (see Program Page and the direct communications you received from Sponsor notifying you that you have a User Birthday Reward to claim for more details, including any wagering or game play requirements, percentages, expiration or other restrictions on a User Birthday Reward)
  • Any available FanDuel Sportsbook Rewards Club promotions and “VIP Level Exclusive” FanDuel Sportsbook Rewards Club promotions as described on the FanDuel Sportsbook Rewards Club platform (see Program Page for more details).
  • Weekly “VIP Level” Choose-Your-Own-Reward – During any Program Week, you will receive a Weekly Reward. To claim your Weekly Reward, you must, during a Program Week, open your Program Page and choose between the options presented for your Weekly Reward. Your Weekly Reward must be claimed and used by the completion of the Program Week in which it is made available to you. (see Program Page for more details, including any wagering or game play requirements, token percentages, expiration or other restrictions on a Weekly Reward)
  • One “VIP Level” Monthly Wildcard offer.  Each Monthly Wildcard will be claimable by you on your Program Page and must be claimed, at a minimum, within one (1) day of appearing on your Program Page, but such time period may be made longer at Sponsor’s discretion and as communicated directly to you by Sponsor. Any Profit Boost Token, Bet Reset Token, or Sportsbook Bonus Bets contained within a Monthly Wildcard will expire, at a minimum, seven (7) days after being claimed, but such time period may be made longer at Sponsor’s discretion and as communicated directly to you by Sponsor. (see Program Page for more details, including any wagering or game play requirements, token percentages, expiration or other restrictions on a Monthly Wildcard).
  • The opportunity to enter weekly “VIP Level Exclusive” Sportsbook Sweepstakes. Opt-in required to participate.  (see Program Page for more details)

The Rewards may be active on your FanDuel Account from the date of your acceptance of these Terms and Conditions (the “Acceptance Period”). The Acceptance Period begins upon accepting these Terms and Conditions as described in Section 4 above. Certain Rewards are limited in supply, and are available on a first-come, first-served, while supplies last basis. If a Reward is not available on the Program Page because supply has exhausted, Sponsor may, at its discretion, make an alternate Reward available on the Program Page during the Program Period. Sponsor reserves the right, but has no obligation, to modify the period of time in which a participant who receives Rewards in connection with this Program has to use such Rewards. If applicable, certain Rewards will be credited to your account within Seventy-Two (72) hours of your claiming of such Reward. Any market, wager, amount restrictions on any Rewards will be communicated by Sponsor on the Program Page associated with the specific Reward. Rewards are non-transferable, with no equivalents or substitutions except at Sponsor’s sole and absolute discretion. 

Reward recipients will be solely responsible for all federal, state and local taxes, and for any other fees or costs associated with the Rewards received, regardless of whether the Rewards, in whole or in part, is used. Rewards values may be reported for tax purposes as required by law. All Rewards details not specified in these Terms and Conditions will be determined in Sponsor’s sole and absolute discretion. Rewards details and availability are subject to change and rules and restrictions, and in the event that Sponsor is unable to provide the recipient with their Rewards, Sponsor may elect to provide recipient with the approximate value of such Rewards in cash or award an alternate offering of comparable or greater value. Rewards are delivered “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). The ARV of a Reward is based on available information provided to Sponsor and the value of any Rewards awarded to a recipient may be reported for tax purposes as required by law. Participants may be required to provide Sponsor with a valid Social Security number before a Rewards will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of recipient. Unclaimed Rewards will be forfeited. The Program Entities are not responsible for and will not replace any lost, mutilated or stolen Rewards or any Rewards that is undeliverable or does not reach the recipient because of incorrect or changed FanDuel Account information or other recipient information. The Program Entities are not responsible for and recipients will not receive any difference between the actual value of a Rewards at the time of award and the stated ARV in these Terms and Conditions or in any Program-related correspondence or material. You must have opted in to receive FanDuel communications in your FanDuel Account to receive communications regarding the Rewards you have received pursuant to your participation in the Program.

6. Registration Procedures 

To qualify for the Program, eligible individuals must have an active FanDuel Sportsbook account (“FanDuel Account”) in order to participate in this Program and verify your identity in order to play in the FanDuel Sportsbook app. Creating a FanDuel Account at fanduel.com or sportsbook.fanduel.com is free. By submitting your information and creating a FanDuel Account, however, participants will be required to agree to the FanDuel Terms of Use (fanduel.com/terms) and consent to the FanDuel Privacy Policy (fanduel.com/fanduel-sportsbook-privacy-policy). If you do not agree to FanDuel’s Terms of Use and consent to FanDuel’s Privacy Policy, you cannot create a FanDuel Account or participate in this Program.

7. Limitations on Participation 

In addition to the eligibility requirements in Section 3 above, Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in this Program for any reason, in our sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous promotion in good faith. Sponsor also reserves the right to revoke any improperly awarded Rewards, whether due to your conduct or an error on the part of Sponsor. This Program is void where prohibited by law. 

Participants entering the Program concurrently with wording, depiction, images or actions that Sponsor considers, in its sole discretion, to be vulgar, profane, offensive or otherwise inappropriate shall not be eligible to participate in the Program. 

For the avoidance of doubt, only wagers on the FanDuel Sportsbook placed in the states of Arizona, Arkansas, Colorado, Connecticut, the District of Columbia, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana (excluding the following parishes: Caldwell, Catahoula, Franklin, Jackson, LaSalle, Sabine, Union, West Carroll and Winn), Maryland, Massachusetts, Michigan, Missouri, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Tennessee, Vermont, Virginia, West Virginia, or Wyoming will be eligible to earn Program points.

8. Wagering Requirements 

See Section 5 above. Any wager placed prior to agreeing to these Terms and Conditions will not count towards the Program. Wagers that are settled using the “Cash Out” feature will not count towards the Program. Separately, wagers placed using site credits or any bonus received from a separate Sponsor promotion will not count towards the Program. 

 

9. Order of Funds Used for Wagering 

Sportsbook Bonus Bets, Profit Boost Tokens, and Bet Reset Tokens must be manually selected in the betslip window of your FanDuel Account in order to be used before deposited funds when wagering.

10. Eligible Games 

See Section 5 above. All of Sponsor’s markets offered during the Program Period are eligible to earn points for the FanDuel Sportsbook Rewards Club.

11. Restrictions on Withdrawal 

The Rewards are not transferable and cannot be substituted except in the Sponsor’s sole discretion.  Rewards are non-withdrawable, but any winnings therefrom are immediately withdrawable. Rewards may only be used for wagering on your FanDuel Account.  Deposited funds that have not been played may be refunded at any time. 

12. Cancellation

14. Additional Terms

 

Administration: Sponsor expressly reserves the right to amend, suspend or terminate this Program at any time without prior notice or consent. Administration of this Program is at the sole discretion of Sponsor. Sponsor reserves the right to restrict at any time any person from participating in this Program for any reason. In the event Sponsor is prevented from continuing with the Program by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Program by any party, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each, a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend or terminate the Program. Sponsor additionally reserves the right, in its sole and absolute discretion: (i) to modify, suspend or terminate the Program should a Force Majeure event or occurrence corrupt or interfere with the administration, integrity, operation, security or proper play of the Program; or (ii) to disqualify any participant found to be, or suspected of: (a) tampering with the entry process or the operation of the Program; (b) acting in violation of these Terms and Conditions; or (c) acting in an unsportsmanlike manner.

Any questions relating to eligibility, these Terms and Conditions or any other questions concerning this Program will be resolved at the sole discretion of Sponsor and its decisions will be final and binding with respect thereto. No groups, clubs, corporations, companies, partnerships or organizations may reproduce or distribute any portion of these Terms and Conditions to their members.

Release and Waiver of Liability: By participating in this Program, individuals agree to release, defend, indemnify and hold harmless the Program Entities and each of their directors, officers, employees, representatives and agents (collectively, the “Released Parties”) from and against any and all liability claims, actions, costs (including attorneys’ fees) of any kind whatsoever (however named or described) for injuries, death, damages or losses in connection with: (i) your participation in the Program; (ii) the receipt, use or misuse of any Rewards, or while preparing for, participating in, and/or traveling to any Program-related activity, including those damages caused by Sponsor’s own negligence; (iii) compliance with any FanDuel or Rewards provider terms of service, code of conduct or similar terms and conditions; (iv) the Released Parties’ actual or alleged violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or claims of infringement of intellectual property or other rights; and (v) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Program activity or Rewards. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of any Rewards. 

Publicity: Subject to applicable law, recipients irrevocably grant the Program Entities and each of their licensees, successors, assigns and sub-licensees the right and permission to use their name, voice, likeness and/or biographical material for advertising, promotional and/or publicity purposes in connection with the Program, in all forms of media and by any and all means and media (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration, except for providing the Rewards to recipients. By participating in the Program, recipients agree to refrain from any behavior or communication that would harm the image or reputation of the Program Entities or the FanDuel user community.

No Third-Party Sponsor: This Program is in no way sponsored, endorsed or administered by, or in association with any person or other entity, including any third party, other than FanDuel. References to third parties are for reference and identification purposes only and are not intended to suggest sponsorship, endorsement or affiliation with FanDuel or the Program.

Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations of recipients and Sponsor in connection with the Program will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

Dispute Resolution: You agree that any claim or dispute that has arisen or may arise relating in any way to or arising out of the Program or these Terms and Conditions will be resolved in accordance with the dispute resolution provisions set forth in the “Binding Arbitration and Class Action Waiver” Section of the FanDuel Terms of Use (https://www.fanduel.com/terms) (toggle to “Sportsbook”). This Section of the FanDuel Terms of Use requires you to resolve disputes by binding arbitration and you agree to waive the ability to bring claims in a class action format. 

LIMITATION OF LIABILITY: BY PARTICIPATING IN THIS PROGRAM, INDIVIDUALS AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (I) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROGRAM OR ANY REWARD REDEEMED WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (II) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (III) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND PARTICIPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (IV) PARTICIPANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

Miscellaneous: No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect. Participants agree to waive any rights to claim ambiguity of these Terms and Conditions. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Program-related materials, privacy policy or terms of use on any website, social media platform or application and/or the terms and conditions of these Terms and Conditions, these Terms and Conditions shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion. 

Entry Information and Program Communications: As a condition of participating in this Program, each participant gives consent for Sponsor to obtain and deliver their name, address and other information to third parties for the purpose of administering this Program and to comply with applicable laws, regulations and rules. Any information participant provides to Sponsor may be used to communicate with participant in relation to this Program. By participating in the Program, recipient consents to all of the terms and conditions of FanDuel’s Privacy Policy, which is available at fanduel.com/fanduel-sportsbook-privacy-policy.

CAUTION: ANY ATTEMPT TO DAMAGE SPONSOR’S WEBSITES OR APPS OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS PROGRAM OR ANY PROGRAM OFFERED BY SPONSOR IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
